IMPORTANT – PLEASE READ CAREFULLY

By registering for and/or participating in the Borneo Half Marathon (“Event”), co-organised by the Kinabalu Running Club & Dewan Bandaraya Kota Kinabalu (“Organiser”), you (“Participant”) agree to be legally bound by the following Terms & Conditions.

Acceptance of Terms

By submitting your registration, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.

The Organiser reserves the right to amend these Terms & Conditions at any time at its sole discretion without prior notice. Any amendments shall take effect immediately upon publication on the official Event website.

Eligibility

Participation is open to individuals who meet the minimum age requirement for the respective race categories as stated. A participant’s age category is determined based on his or her age on the date of the race, and all participants must meet the minimum age requirement for their chosen category. The Organiser reserves the right to verify eligibility and disqualify any Participant who fails to meet the requirements.

Registration

All registration fees are strictly non-refundable, non-transferable, and non-deferrable, regardless of circumstances.
Registration is valid only after full payment has been received and an official confirmation has been issued by the Organiser.
Registered Participants are not permitted to change their race category once registration has been confirmed.
Bib numbers, timing chips, and other race credentials are strictly personal and must not be exchanged, transferred, or sold to any other person. Any violation will result in immediate disqualification.

Race Pack Collection

Race packs must be collected at the designated times and venues announced by the Organiser.
Failure to collect race packs within the stipulated period will result in forfeiture without refund.
No on-site collection will be permitted on Event day unless otherwise notified by the Organiser.

Race Pack Postage

Race pack postage is available within Malaysia only.
Each postage add-on is valid for one (1) race pack only.
Race packs sent via postage are expected to arrive within five (5) to seven (7) days before Event day.
The Organiser shall not be held responsible for any delays, loss, or damage arising from postal or courier services.

Race Entitlements

Each registered Participant shall be entitled to the following, subject to the conditions stated:
- Event T-shirt: 11KM & Half Marathon.
- Finisher’s Medal: 11KM & Half Marathon, subject to completion within the official Cut-Off Time.
- Finisher’s T-shirt: Half Marathon only, subject to completion within the official Cut-Off Time.
- Finisher’s Certificate: 11KM & Half Marathon, available online, subject to completion within the official Cut-Off Time.
- Goodie Bag.
No replacement will be made for lost or stolen medals.
No exchange of Event T-shirt or Finisher’s T-shirt sizes will be permitted during Race Pack Collection, at the finish line, or after the Event.

Event Changes, Postponement & Cancellation

The Organiser reserves the right to postpone, cancel, or amend the Event (including but not limited to race routes, start times, and categories) due to weather conditions, public safety concerns, or any circumstances beyond reasonable control.
In such circumstances, no refunds will be provided. The Organiser may, at its sole discretion, offer alternative arrangements (including but not limited to deferment or virtual participation).

Assumption of Risk & Waiver of Liability

Participation in the Event is at the Participant’s own risk. By registering, the Participant affirms that he or she is physically fit, medically able, and has adequately trained to participate in the Event.
The Participant accepts all risks associated with participation, including but not limited to injury, illness, loss, or death, whether occurring before, during, or after the Event.
In consideration of being permitted to take part, the Participant irrevocably waives, releases, and discharges the Organiser, its officials, sponsors, partners, contractors, volunteers, and all persons associated with the Event from any and all liability, claims, demands, losses, or damages of any kind arising from or in connection with the Event.
By completing the registration, the Participant agrees to indemnify and hold harmless the Organiser, its officials, sponsors, partners, contractors, employees, and associates, whether directly or indirectly involved in the Event, against any liability, claims, demands, losses or damages resulting from the Participant’s involvement in the Event.
This waiver applies to all claims, whether known or unknown, and extends to the Participant’s heirs, executors, administrators, and assigns.

Race Rules & Regulations

Cut-Off Time (COT)

The Cut-Off Time will be strictly enforced: 3.5 hours for Half Marathon and 2 hours for 11KM.
Participants exceeding the Cut-Off Time will be escorted (‘swept’) back to the Start/Finish area.

Race Bib

Race bib swapping is strictly prohibited. Each bib is registered with the Participant’s personal and emergency details.
Any Participant found swapping bibs will be immediately disqualified and may have their identity disclosed to other race organisers.
For security reasons, only Participants wearing an official race bib will be allowed on the course. Police, enforcement officers, and marshals will remove any unauthorised individuals. Offenders’ details may be recorded and shared with other race organisers.

Code of Conduct

Participants must comply with all race rules, regulations, and instructions given by the Organiser, marshals, medical
personnel, or relevant authorities at all times.
The following conduct is strictly prohibited:
- Cheating, including course-cutting or receiving unauthorised assistance.
- Use of prohibited or dangerous items.
- Disorderly, abusive, or unsportsmanlike behaviour.
- Littering outside of designated disposal areas.
Any violation of the above may result in immediate disqualification without refund.

Timing Chip

The electronic timing chip provided by the Organiser must be worn and used by all Participants as instructed.
Failure to wear the timing chip may result in no official time being recorded and disqualification from the official
results.
The Organiser shall not be held responsible for any failure of timing recording arising from incorrect usage, loss, or
damage of the timing chip by the Participant.

Results, Prizes & Awards

All official results and decisions of the Organiser are final and binding.
Only the Top five (5) winners in each category who complete the race within the official Cut-Off Time are eligible for
prizes.
Winners must present valid identification and comply with all prize collection requirements.
All winners are required to sign a declaration verifying the accuracy of their personal information prior to prize
collection.
Prizes may be awarded in cash or via bank transfer, at the discretion of the Organiser.
All prizes are quoted in Malaysian Ringgit (RM).
Unclaimed prizes after the stipulated collection period will be forfeited without further notice.
The Organiser reserves the right to amend prize categories, prize money, or amounts as deemed necessary.

Photography, Recording & Publicity

By participating, the Participant consents to the use of his or her name, image, voice, and race results by the Organiser
and its partners for promotional, commercial, and media purposes without compensation.
All intellectual property rights in Event materials, logos, and media belong to the Organiser. Unauthorised use is strictly
prohibited.

Personal Data & Privacy

The Participant consents to the Organiser collecting, using, and disclosing personal data for purposes related to the
administration of the Event, including but not limited to registration, timing, insurance, results processing, and
communications.
Personal data may be shared with service providers, sponsors, and partners strictly for purposes related to the Event.
The Organiser will comply with the Malaysian Personal Data Protection Act 2010 (PDPA) in handling all personal
information.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Severability

If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall
remain in full force and effect.
